With the Immigration Reform and Control Act of 1986 (IRCA) Congress instituted employer sanctions, including criminal and civil penalties, against employers that hire persons who are not legally authorized to work in the U.S. In order to comply with the law against hiring unauthorized workers, all U.S. employers are required to verify the identity and employment eligibility of all new employees, including U.S. citizens and permanent residents.

This is done by recording employee information on Form I-9 and reviewing documents listed on the back of Form I-9 that establish both the employee's identity and eligibility to work. Every employer, regardless of size or number of employees must complete this employment verification process.

I-9 forms must be updated when the document provided by the employee for employment authorization has an expiration date. Therefore, I-9s should be regularly audited. Form I-9 must be retained for a period of 3 years or 1 year after the employee's termination date. Form I-9 is not required for the following persons:

  • Employees hired on or before November 6, 1986, and continuously employed by the same employer;
  • Employees hired for casual domestic work in a private home on a sporadic, irregular or intermittent basis;
  • Independent contractors;
  • Workers provided to employers on a contract basis. (In such case, the contracting party is the employer for I-9 purposes.)
